不正當(dāng)廣告行為是指在工商業(yè)活動(dòng)中違反商業(yè)慣例和善良風(fēng)俗的廣告違法行為。隨著市場經(jīng)濟(jì)的進(jìn)一步發(fā)展，廣告違法行為開始層出不窮，這不僅加劇了市場競爭者之間的矛盾沖突，還嚴(yán)重?fù)p害了作為市場經(jīng)濟(jì)參與者之消費(fèi)者的合法權(quán)益。因而，有必要在經(jīng)濟(jì)法領(lǐng)域?qū)Σ徽?dāng)廣告行為進(jìn)行法律規(guī)制，即通過立法完善和強(qiáng)化司法監(jiān)管的方式最大程度凈化廣告市場經(jīng)營秩序，切實(shí)保障廣告受眾的合法權(quán)益。本文嘗試從不正當(dāng)廣告行為的概念形式和法制建設(shè)現(xiàn)狀這兩個(gè)方面出發(fā)，結(jié)合我國最新頒布的《廣告法》和相關(guān)廣告違法案例，并總結(jié)借鑒世界各國的廣告立法經(jīng)驗(yàn)，發(fā)現(xiàn)我國廣告立法的缺陷和不足之處，在此基礎(chǔ)上提出完善廣告違法行為的法律規(guī)制建議。 不正當(dāng)廣告行為 法律規(guī)制 立法完善 司法管轄 |

| Improper advertising behavior refers to unlawful advertising act in industrial and commercial activities which violate the Business practices and good customs. With the further development of the marketeconomy, advertising illegal behavior begins to emerge endlessly, which accelerates the conflict between competitor as well as causes serious damage to legitimate interests between the participants of market economy and customer.Therefore, it is necessary to govern the legislation in economic law field for Improper advertising behavior by improving legislation and strengthening the judicial supervision to purify the advertising market operation order at utmost and protect the lawful rights and interests of the advertising audience. From the inappropriate advertising form and the concept of legal system construction situation with combining "advertisement law" which China's promulgated latest and the related advertising illegal cases, as well as concluding the experience of advertising legislation all over the world, defects and deficiencies in Chinese advertising legislation can be found and some Legal regulation suggestions are put forward to improve advertising illegal act on this base. |
