J1簽證回國不滿兩年，再次J1簽證赴美問題

各位前輩： 近日有幸拿到美國的offer去做博士后，商定為一年時間，有一些簽證問題不明白，希望大家踴躍發(fā)言。對方給的是J1簽證，由于在下曾持J1簽證在美學習過一點時間，尚未脫離歸國兩年限制，無法申請豁免，可能辦理簽證會有一定的麻煩，據(jù)我所知，我這種情況申請J1短期簽證（最長6個月）再次赴美是可以的，然后回來再次辦理簽證，請各位有經(jīng)驗的大俠指點一下。如果這樣做的話，如何和外導溝通？（能貼上來英語表述有獎勵奧）邀請信和DS-2019表上的時間期限又該如何表述較為合理？二者是否需要完全一致？是否都寫為6個月，等6個月過后再延長DS-2019表上的時間期限，帶著回國再次辦理簽證？ |

2年回國限制不適用于再次申請j1，任何時間點2年回國限制不影響再申請j1。你說的內容我覺得是 two-year bar，也就是說24個月內不能申請2019那個 New regulations impacting a J-1 visitor to the U.S. in a research scholar or professor category took effect on November 11, 2006. Two major changes happened: First, J-1 visitors in the research scholar or professor category may be eligible for an additional two years of that classification for up to a five-year uninterrupted period (not an aggregate of five years). Accordingly, individuals in the U.S. in the research scholar or professor category may be eligible to hold J-1 status in that category for up to five calendar years from the start of the program, regardless of how much time is actually spent in the U.S. during that period. Second, any J-1 visitor in the research scholar or professor category will be subject to a two-year bar from returning to the U.S. in either category once their SEVIS (Student and Exchange Visitor Information System) record is completed. Once a program is completed, a J-1 visitor in the research scholar or professor category may not be eligible to hold J-1 visitor status in the research scholar or professor category for two years (whether the program was completed after three weeks or after five years). For example, this means that a J-1 visitor to the U.S. in the research scholar or professor category on a nine-month (academic year) program may be subject to the two-year bar from either J-1 category at the completion of that one-year program. This two-year bar or waiting period should not be confused with the two-year home residency requirement; however, both requirements may be fulfilled simultaneously. 不過少見的例外情況是 Any J exchange visitor in the Research Scholar or Professor categories (and their J-2 dependents) whose J-1 program ends on or after November 18, 2006 is subject to the 24 month bar. The J-1 program end date can be found in section 3 of your DS-2019. The J-1 category can be found in section 4. J exchange visitors in the Short-Term Scholar, Specialist or Student categories are not subject to the 24 month bar. The J category can be found in section 4 of your DS-2019. However, you may be able to return in a different J-1 category or with a different type of visa. 你沒說清楚前面j1啥時候結束的，哪一種j1。不確定 two-year bar是否起效，我確定2年回國要求和再次申請j1沒關系，更與豁免沒關系。2年限制是可通過你想那辦法規(guī)避，但半年以后你回不去可能很大。不如等到2年bar過去，要個h1過去啊。 |
