The biotech world thought that the answer was clear already: Many companies have been built on the assumption that DNA sequences can be patented exclusively. But on 30 November, the court indicated that may not be so. 美國最高法院打算解決一個(gè)在生物和法律界影響深遠(yuǎn)的問題:人類基因可不可以專利化?生物科技領(lǐng)域早認(rèn)為答案已經(jīng)非常清楚:許多公司的建立正是基于DNA序列完全可以專利化的假定。然而,11月30號最高法院卻暗示情況或許并不是這樣的。 It granted certiorari to a case known as Association for Molecular Pathology v. Myriad Genetics, agreeing to hear a challenge against Myriad, a diagnostics firm in Salt Lake City, which owns patents on the human breast and ovarian cancer genes BRCA1 and BRCA2. Myriad has created a database of DNA variants and uses a patented test to check individuals for cancer risk. 最高法院對“分子病理學(xué)會(huì)對Myriad Genetics公司”案件下發(fā)了調(diào)案復(fù)審,同意舉行對Myriad Genetics公司的質(zhì)詢聽證會(huì)。Myriad Genetics是一家位于鹽湖城的診斷公司,擁有人類乳腺癌和卵巢癌基因圖譜BRCA1 和BRCA2的專利。這家公司已經(jīng)建成了一個(gè)DNA變異體的數(shù)據(jù)庫,同時(shí)還使用一項(xiàng)已取得專利的檢驗(yàn)手段來測試人們患癌癥的風(fēng)險(xiǎn)。 The group challenging Myriad argues that the key genes are a product of nature and, therefore, not patentable—a position backed by many researchers—including Nobel winner James Watson—and a number of medical groups, including the American Medical Association.
