J1簽證回國(guó)不滿兩年，再次J1簽證赴美問題

各位前輩： 近日有幸拿到美國(guó)的offer去做博士后，商定為一年時(shí)間，有一些簽證問題不明白，希望大家踴躍發(fā)言。對(duì)方給的是J1簽證，由于在下曾持J1簽證在美學(xué)習(xí)過一點(diǎn)時(shí)間，尚未脫離歸國(guó)兩年限制，無法申請(qǐng)豁免，可能辦理簽證會(huì)有一定的麻煩，據(jù)我所知，我這種情況申請(qǐng)J1短期簽證（最長(zhǎng)6個(gè)月）再次赴美是可以的，然后回來再次辦理簽證，請(qǐng)各位有經(jīng)驗(yàn)的大俠指點(diǎn)一下。如果這樣做的話，如何和外導(dǎo)溝通？（能貼上來英語表述有獎(jiǎng)勵(lì)奧）邀請(qǐng)信和DS-2019表上的時(shí)間期限又該如何表述較為合理？二者是否需要完全一致？是否都寫為6個(gè)月，等6個(gè)月過后再延長(zhǎng)DS-2019表上的時(shí)間期限，帶著回國(guó)再次辦理簽證？ |

2年回國(guó)限制不適用于再次申請(qǐng)j1，任何時(shí)間點(diǎn)2年回國(guó)限制不影響再申請(qǐng)j1。你說的內(nèi)容我覺得是 two-year bar，也就是說24個(gè)月內(nèi)不能申請(qǐng)2019那個(gè) New regulations impacting a J-1 visitor to the U.S. in a research scholar or professor category took effect on November 11, 2006. Two major changes happened: First, J-1 visitors in the research scholar or professor category may be eligible for an additional two years of that classification for up to a five-year uninterrupted period (not an aggregate of five years). Accordingly, individuals in the U.S. in the research scholar or professor category may be eligible to hold J-1 status in that category for up to five calendar years from the start of the program, regardless of how much time is actually spent in the U.S. during that period. Second, any J-1 visitor in the research scholar or professor category will be subject to a two-year bar from returning to the U.S. in either category once their SEVIS (Student and Exchange Visitor Information System) record is completed. Once a program is completed, a J-1 visitor in the research scholar or professor category may not be eligible to hold J-1 visitor status in the research scholar or professor category for two years (whether the program was completed after three weeks or after five years). For example, this means that a J-1 visitor to the U.S. in the research scholar or professor category on a nine-month (academic year) program may be subject to the two-year bar from either J-1 category at the completion of that one-year program. This two-year bar or waiting period should not be confused with the two-year home residency requirement; however, both requirements may be fulfilled simultaneously. 不過少見的例外情況是 Any J exchange visitor in the Research Scholar or Professor categories (and their J-2 dependents) whose J-1 program ends on or after November 18, 2006 is subject to the 24 month bar. However, you may be able to return in a different J-1 category or with a different type of visa. 你沒說清楚前面j1啥時(shí)候結(jié)束的，哪一種j1。不確定 two-year bar是否起效，我確定2年回國(guó)要求和再次申請(qǐng)j1沒關(guān)系，更與豁免沒關(guān)系。2年限制是可通過你想那辦法規(guī)避，但半年以后你回不去可能很大。不如等到2年bar過去，要個(gè)h1過去啊。 |
